1. Parties and agreement

These terms form part of the agreement between the plant hire company (“the Hire Company”) and the person or organisation hiring the equipment (“the Hirer”). The booking details, equipment details, charges and these terms together form the Hire Agreement.

2. Ownership

The equipment remains the property of the Hire Company at all times. The Hirer must not sell, assign, pledge, lend, sub-hire or otherwise dispose of the equipment.

3. Hire period and charges

Hire charges apply for the agreed hire period and continue until the equipment is returned to, or collected by, the Hire Company. Additional charges may apply for late return, transport, fuel, excessive cleaning, missing accessories, damage or loss. VAT will be charged where applicable.

4. Care, security and permitted use

The Hirer must use the equipment only for its intended purpose, follow the manufacturer’s instructions and safety information, keep it secure and take reasonable care of it. Identification plates, safety notices and guards must not be removed or altered.

5. Safe operation, injury and personal responsibility

The Hirer must ensure that the equipment is operated only by competent, trained and authorised persons, in accordance with the manufacturer’s instructions and applicable Irish health and safety requirements. To the fullest extent permitted by Irish law, Dan Dempsey’s Tool & Plant Hire is not liable for injury, loss or damage arising from misuse, incorrect operation, unauthorised alteration, negligent use or use by an untrained or unauthorised person. Nothing in these terms excludes liability that cannot lawfully be excluded.

6. Daily checks, fuel and cleaning

The Hirer must carry out appropriate routine checks, including fluid levels, visible damage, tyres or tracks, guards and safety devices. Unless otherwise agreed, equipment must be returned with the same fuel level and in a reasonably clean condition.

7. Breakdown and repairs

The Hirer must stop using the equipment and notify the Hire Company immediately if a defect, breakdown or unsafe condition arises. The Hirer must not repair or alter the equipment without prior approval. The Hire Company is not responsible for delay or consequential loss arising from breakdown except where liability cannot lawfully be excluded.

8. Damage, concrete contamination, loss and additional charges

The Hirer is responsible for damage occurring during the hire period other than fair wear and tear. Any repair, replacement or specialist cleaning cost will be charged in addition to the agreed hire price. This includes, without limitation, concrete, cement, mortar, plaster, paint, asphalt or other material left on the machine or attachments; damaged tyres, tracks, hoses, cables, guards or components; missing keys or accessories; and damage caused by misuse, poor security or improper transport. Damage, theft, fire, vandalism, accident or loss must be reported immediately.

9. Insurance

The Hirer must maintain any insurance reasonably required for the equipment, its use and third-party liability unless the Hire Company confirms alternative arrangements in writing. Insurance does not remove liability for exclusions, excesses or uninsured loss where permitted by law.

10. Delivery, collection and access

The Hirer must provide safe and suitable access for delivery and collection. The Hirer is responsible for accurately identifying the hire location and any site restrictions. Waiting time or failed delivery or collection caused by inadequate access or incorrect information may be charged.

11. Payment and deposits

The Hirer must pay the charges, deposit and any valid additional charges when due. Deposits may be applied against unpaid charges, damage, loss, fuel, cleaning or other sums properly due. Commercial customers may be subject to statutory interest and compensation on qualifying late payments under applicable Irish late-payment legislation.

12. Cancellation and early return

Cancellation charges may apply where equipment has been reserved, prepared, transported or made unavailable to another customer. Early return does not automatically entitle the Hirer to a refund unless agreed by the Hire Company or required by law.

13. Consumers

Where the Hirer is a consumer, nothing in these terms limits or excludes rights or remedies that cannot lawfully be limited or excluded, including rights under applicable Irish consumer law. Any term that conflicts with a mandatory consumer right will apply only to the extent permitted by law.

14. Personal data and privacy

Customer information is processed to administer bookings, provide equipment, manage payments, communicate about the hire, maintain records and meet legal obligations. The Hire Company must provide a separate privacy notice explaining the controller’s identity, purposes and legal bases, recipients, retention periods and data-subject rights.

15. Governing law

This agreement is governed by the laws of Ireland. The Irish courts will have jurisdiction, subject to any mandatory consumer jurisdiction rights.

Damage, theft, fire, vandalism, accident or loss must be reported immediately.

The Hirer must maintain any insurance reasonably required for the equipment, its use and third-party liability unless the Hire Company confirms alternative arrangements in writing. Insurance does not remove liability for exclusions, excesses or uninsured loss where permitted by law.

10. Delivery, collection and access

The Hirer must provide safe and suitable access for delivery and collection. The Hirer is responsible for accurately identifying the hire location and any site restrictions. Waiting time or failed delivery or collection caused by inadequate access or incorrect information may be charged.

11. Payment and deposits

The Hirer must pay the charges, deposit and any valid additional charges when due. Deposits may be applied against unpaid charges, damage, loss, fuel, cleaning or other sums properly due. Commercial customers may be subject to statutory interest and compensation on qualifying late payments under applicable Irish late-payment legislation.

12. Cancellation and early return

Cancellation charges may apply where equipment has been reserved, prepared, transported or made unavailable to another customer. Early return does not automatically entitle the Hirer to a refund unless agreed by the Hire Company or required by law.

13. Consumers

Where the Hirer is a consumer, nothing in these terms limits or excludes rights or remedies that cannot lawfully be limited or excluded, including rights under applicable Irish consumer law. Any term that conflicts with a mandatory consumer right will apply only to the extent permitted by law.

14. Personal data and privacy

Customer information is processed to administer bookings, provide equipment, manage payments, communicate about the hire, maintain records and meet legal obligations. The Hire Company must provide a separate privacy notice explaining the controller’s identity, purposes and legal bases, recipients, retention periods and data-subject rights.

15. Governing law

This agreement is governed by the laws of Ireland. The Irish courts will have jurisdiction, subject to any mandatory consumer jurisdiction rights.
